These are accepted without reservation by all customers placing an order on our Website. All other documents are for information purposes only. We reserve the right to make changes at any time without notice. Any use, reproduction or distribution of all or part of the content of our Website is strictly prohibited, other than for personal and private non-commercial use.

Article 1: Application of the General Terms and Conditions



1.1 These General Terms and Conditions of Sale (hereinafter the "GTCS") apply without restriction or reservation to all sales made by LOMBARD & MEDOT, a Public Limited company (société anonyme) with a management board and a share capital of €978,076.00, whose registered office is at 1 Rue des Cotelles - BP 188 51204 Epernay Cedex - France, intra-Community VAT number FR 68 095 750 303, to its customers, i.e. non-professional purchasers (legal or natural persons), hereinafter the "Customer(s)", wishing to purchase the products offered for sale by LOMBARD & MEDOT, on its website https://boutique.champagne-lombard.com (hereinafter the “Website »).

The GTCS form an indivisible whole with the price list and pricing conditions indicated on the Website.

The GTCS may be supplemented by special conditions, set out on the website, prior to any transaction with the Customer.

These GTCS apply to the exclusion of all other conditions, in particular those applicable to in-store sales or sales via other distribution and marketing channels.

1.2 All orders imply full and unreserved acceptance of the GTCS. These GTCS are subject to change at any time. The GTCS may be consulted at any time on the Website and will prevail, where applicable, over all other contradicting versions or documents. In the absence of proof to the contrary, the data recorded by LOMBARD & MEDOT constitute proof of all transactions. Changes to these GTCS are enforceable against Website users as from the time they are published online and cannot apply to any prior transactions.

Article 2: Products



The Products offered for sale on the Website by LOMBARD & MÉDOT are as follows: Champagne, wines, spirits. LOMBARD & MÉDOT reserves the right to modify its range at any time to reflect changes in the Product ranges it markets, without this giving rise to any right to compensation.

The main characteristics of the Products are presented on the Website. The Customer is required to read these characteristics before placing an order. Products are chosen and purchased under the Customer’s sole liability.

The Customer acknowledges that Products purchased on the Website may not be resold or used for commercial purposes. They can be used as gifts.



Article 3: Orders



3.1 When ordering, the Customer must provide personal information in order to create an account and confirm the order (name, company, postal address, telephone number, e-mail address, etc...). We undertake to respect the confidentiality of personal data provided by the customer. Furthermore, we do not communicate any collected data to third parties. Our Website cannot be held liable if the information provided by the customer proves to be incomplete or inaccurate, thereby hindering the ordering, payment or delivery process.

 

3.2 As soon as the customer has confirmed the order and paid for it, our Company will confirm the order to the customer by e-mail and the order will become final. In the event of unavailability of one or more products, we will inform you immediately in order to offer you an alternative solution, while respecting your initial choices. 

 

3.3 LOMBARD & MÉDOT reserves the right to cancel any non-compliant or dubious order, as well as those from a customer with whom there is any dispute. The customer will be informed immediately of any such refusal. Our company cannot be held liable for any consequences borne by the customer in the event of our refusal to confirm the order.

Article 4: Price



4.1 Bottle prices are in euros and include VAT, excluding any shipping costs. These delivery costs will be indicated during confirmation of your order, before payment. Customers subscribing to the Club page will receive free shipping from LOMBARD & MÉDOT.

 

4.2 We reserve the right to modify the prices of our products at any time and without prior notice. Delivery prices are subject to change without notice. 

These possible changes in shipping costs do not apply to orders that have already been confirmed (once we have sent the order confirmation to the customer). 


Article 5: Delivery



5.1 Delivery times

5.1.1 LOMBARD & MÉDOT delivers to the address indicated by the Customer at the time of ordering, in mainland France only, excluding Corsica.

 

5.1.2 Orders are dispatched within 7 working days of receipt of payment. Non-working days include Saturdays, Sundays and public holidays, as well as days on which the Company's wineries are closed. LOMBARD & MÉDOT undertakes to use its best efforts to deliver the Products ordered by the Customer within the time limits specified above.

 

5.1.3 Except in special cases or when one or more Products are unavailable, all Products ordered will be grouped into one delivery. For a given order, LOMBARD & MÉDOT reserves the right to make multiple deliveries where necessary. No penalty may be applied by the customer to LOMBARD & MÉDOT and no damages may be claimed as a result, which the customer expressly acknowledges and accepts.

 

5.2 Transport and transfer of risks

 

5.2.1 Delivery is made by La Poste using the Colissimo service. 

 

5.2.2 The transfer of risks occurs between the parties at the time of the carrier’s first arrival at the place of delivery indicated by the Customer.

 

5.2.3 It is the Customer's responsibility to carefully check the condition of the Products delivered, in order to immediately express any reservations to the carrier. In the event of damage, loss or missing items, the Customer is required to make all necessary observations, with all supporting documents (including photos). No complaints will be accepted if the customer has accepted his parcels without reservation on delivery.

 

5.3 Delivery procedure

5.3.1 LOMBARD & MÉDOT's failure to meet delivery deadlines shall not give rise to penalties for late delivery, damages, withholding, or cancellation of orders in progress.

 

5.3.2 No delay in delivery shall entitle the Customer to cancel, in whole or in part, his/her order or to refuse delivery of the Products, without LOMBARD & MÉDOT having been able to ascertain effectively and in advance, the reality of the grievance of which it is accused by the Customer, except in application of the consumer's right of withdrawal.

The Customer will be informed by LOMBARD & MÉDOT as soon as the carrier takes charge of the parcel. A tracking number will be given to the customer to enable him/her to check the delivery date.

On the day of delivery, a signature will be required against exchange of the parcel. The Customer will be contacted by La Poste. 

If the Customer is absent at the time of delivery, the parcel will be deposited at the post office indicated on the delivery notice left in the Customer's letterbox. The Customer must collect the parcel directly from the post office. 

Items that cannot be delivered to the address are kept in the post office for 15 calendar days from the day after the delivery notice is left. Once this period has expired, La Poste will return the items in accordance with the conditions set out in the General Terms and Conditions of Sale.


Article 6: Online payment



6.1 Payment of the price of the Products is made online, in Euros and in full on the day the order is placed by the Customer, by bank card (CB, Visa and Mastercard are accepted). The customer will receive an email containing a detailed invoice of his/her order issued by the Company. Our Website benefits from a secure payment platform provided by our partner, Crédit Agricole du Nord-Est. With Up2pay e-Transactions, you can be sure of working with a merchant who is authorised by Crédit Agricole to carry out secure transactions on the Internet. Up2pay e-Transactions is certified as compliant with 3D-Secure security standards and PCI-DSS and TLS data protection standards.

6.2 Our Website does not receive any information about your bank card. Your details are automatically encrypted and cannot be intercepted.

6.3 In order to limit the risk of fraud, we may carry out checks on the validity of payments made by bank card on our Website. Should we implement these procedures, the delivery time initially indicated on our Website may be increased by the time required for said checks. Following this verification procedure, we reserve the right to accept or refuse the order. In this case, we will immediately cancel the payment.

6.4 Wines remain the property of S.A. LOMBARD & MEDOT until invoices are paid in full.


Article 7: Order withdrawal and return



Pursuant to the provisions ofArticle L 121-18 of the French Consumer Code, the purchaser has a period of fourteen (14) clear days from the date of delivery of his order to notify the Company of his/her desire to cancel the order. The customer then has a period of fourteen (14) days from this notification to return the order in its original condition, in its original packaging and with the original invoice, without penalty except for the cost of return. If the customer wishes to be reimbursed, the amount of the returned champagne wines will be paid to him/her within 14 days of the date of return of the champagne wines, excluding the initial shipping costs. In addition, if after receipt of the order a customer notes an anomaly attributable to S.A. CHAMPAGNE LOMBARD & MEDOT, we undertake to correct it as soon as possible.

Article 8: Disputes



As LOMBARD & MÉDOT is exclusively responsible for compliance with French legislation, we cannot be held liable for non-compliance with legislative or regulatory provisions in force in France. LOMBARD & MÉDOT shall not be held liable for any misuse of the products sold online on the website. In the event of difficulties in the application of the present contract, the parties must seek an amicable solution before taking any legal action. The Commercial and District Courts of Reims and the Court of First Instance of Châlons-en-Champagne have exclusive jurisdiction for all disputes arising from the performance of our contracts, regardless of the Terms and Conditions of Sale and the method of payment accepted, even in the event of a warranty claim or multiple defendants.


Article 9: Club Lombard General Terms & Conditions of Use

This Program enables Internet users who have created an account (hereinafter the "Members" or the "Member") to accumulate points entitling them to commercial advantages and enabling them to access statuses as detailed below, depending on the amount of purchases eligible for points, made on the boutique.champagne-lombard.com website (hereinafter the “Website”).

Use of the Program by Members is governed by the present General Terms and Conditions of Use (hereinafter the “GTCU”). By accessing the Program, the Member unreservedly accepts the application of the GTCU. The Company may modify and update the GTCU at any time (in particular the conditions for accessing a status, the benefits linked to statuses and the nature of gifts linked to points). The Member will be informed of any updates by email sent prior to any updates, but is invited to regularly consult the online GTCU. These GTCU apply without prejudice to the Website's General Terms and Conditions.

9.1 Club membership conditions

In accordance with the GTCS, the club is only accessible to users who have reached the legal drinking and/or purchasing age according to current legislation.

By subscribing to Club Lombard, the member agrees to receive the company's newsletters. He/she may unsubscribe at any time.

9.3 Loyalty points

Every euro spent on the Champagne Lombard boutique, excluding delivery charges, equals one loyalty point and is accumulated over the course of purchases.

9.5 Responsibility for the Club Lombard program

The Company makes every effort to ensure that the information published on the Club is accurate and up-to-date. The Company reserves the right, at its sole discretion, to terminate the Club, without prior notice and without this being liable to give rise to any compensation to a Member. In this case, however, Members will continue to benefit from their advantages and points for 6 months.



Article 10: Personal Data



10.1 All data provided during your visits to https://boutique.champagne-lombard.com is strictly confidential. None of the Customer's personal data or details will be sold or rented to anyone without their prior consent. Customers' personal data will be used solely for the purpose of contacting them with information relating exclusively to our services: accounting, credit card or other payment card control and selection, marketing and statistical analysis, testing, system maintenance and development, customer surveys, customer relations, improvement of future communications, and better identification of customer needs and preferences.
